In light of the COVID-19 pandemic, the Turkish Parliament has approved the suspension of all time limits on March 26, 2020 covering legal proceedings before the Turkish Courts and requests before the Turkish PTO.  

The Turkish PTO as well as official authorities will remain open and applicants can take advantage of this regulation just in case of any circumstances caused by the pandemic. Requests filed within the regular due date will be still accepted.

Recent regulations covering this suspension can be summarized as follows:

  • All time limits in legal proceedings before the Turkish Courts and the Turkish PTO have been suspended as of March 13, 2020 until April 30, 2020 aiming to prevent the loss of legal rights. The time limits will be running again on May 1, 2020 (in practice on May, 4 2020, due to the weekend and national holiday on May 1, 2020).
  • Applicants who missed due dates after March 13, 2020 do have the right to file their request retroactive now.
  • The law concerns all time limits regarding the origination, exercise and termination of any rights, requests concerning IP rights including oppositions and appeals, maintaining of any IP rights and filing response to office actions etc.
  • The time limit, which expires in 15 days or less as of the suspension period, will be also extended for further 15 days.

We have to point out that our office is open and is set up to work remotely for a while to prevent any risks and to avoid working under stress and pressure during this crisis.

In light of these changes we strictly underline, that our team will continue to work and will accept already existing due dates in order to not cause an overflow of “on hold” tasks on 1st of May 2020.
